General terms and conditions of sale for products sold on the website www.botan.fr
Article 1 – Purpose
These general terms and conditions of sale, described below, detail the rights and obligations of NEW COSMETIC FRANCE and its customers in connection with the sale of the following goods: tanning and moisturizing products, equipment, and accessories.
Any service provided by NEW COSMETIC FRANCE implies the buyer’s unreserved acceptance of these general terms and conditions of sale.
Article 2 – Prices
The prices of our products are shown in euros, inclusive of all taxes (VAT and other applicable taxes on the date of the order), unless otherwise stated, and excluding processing and shipping costs.
For orders shipped to countries other than mainland France, you are considered the importer of the product(s) in question. Customs duties, other local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of NEW COSMETIC FRANCE. They are your responsibility, both in terms of declarations and payments to the relevant authorities and organizations in your country. We advise you to inquire about these matters with your local authorities.
All orders, regardless of origin, are payable in euros.
NEW COSMETIC FRANCE reserves the right to change its prices at any time, but the product will be invoiced based on the price in effect at the time the order is validated and subject to availability.
The products remain the property of NEW COSMETIC FRANCE until full payment of the price.
Please note: as soon as you take physical possession of the ordered products, the risk of loss or damage to the products is transferred to you.

Contractual information is presented in French and will be confirmed no later than when your order is validated.
NEW COSMETIC FRANCE reserves the right to refuse to process a payment or confirm an order for any reason whatsoever, particularly in the event of supply problems or difficulties with the order received.
Article 4 – Order Confirmation
Any order placed on the website www.botan.fr implies acceptance of these Terms and Conditions. Any order confirmation constitutes your full and unreserved acceptance of these Terms and Conditions of Sale.
All data provided and the recorded confirmation will serve as proof of the transaction.
You acknowledge having full knowledge thereof.
The order confirmation will serve as your signature and acceptance of the transactions carried out.
A summary of your order information and these Terms and Conditions will be sent to you via the email address used to confirm your order.
Article 5 – Payment
By confirming your order, you agree to pay the indicated price.
Payment for your purchases can be made either by credit card through the secure systems of CIC or PayPal, or with your PayPal account.
For payments by credit card or PayPal, your card will be debited at the time of ordering. No shipment will be made until full payment has been received.
Article 6 – Right of Withdrawal
In accordance with Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from the date of receipt of your products to exercise your right of withdrawal without having to provide any justification or pay any penalty.
Returns must be made in their original condition and complete (packaging). You are responsible for the condition of the returned items. Any damage to the product during this period may invalidate your right of withdrawal.
Return shipping costs are your responsibility.
If you exercise your right of withdrawal, NEW COSMETIC FRANCE will refund the amounts paid within 14 days of receiving your notification, using the same payment method used for the original order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:
The supply of services fully performed before the end of the withdrawal period and whose performance began after the consumer’s express prior agreement and express waiver of their right of withdrawal.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
Article 7 – Availability
Our products are offered while supplies last and as long as they are visible on the website www.botan.fr.
If a product becomes unavailable after you place your order, we will inform you by email. Your order will be automatically canceled and no payment will be taken.
Furthermore, the website www.botan.fr is not intended for selling products in large quantities. Therefore, NEW COSMETIC FRANCE reserves the right to refuse orders of more than 50 identical items.
Article 8 – Delivery
Products are delivered to the delivery address provided during the ordering process, within the timeframe indicated on the order confirmation page.
In the event of a shipping delay, you will receive an email informing you of any potential impact on the delivery timeframe initially provided.
In accordance with legal provisions, in the event of a delivery delay, you have the option to cancel the order under the terms and conditions defined in Article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will process a refund, including shipping costs, in accordance with Article L 138-3 of the French Consumer Code.
For deliveries made by a carrier, NEW COSMETIC FRANCE cannot be held liable for delivery delays due solely to the customer’s unavailability after several delivery attempts.
Article 9 – Warranty
All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as stipulated in Articles 1641 et seq. of the French Civil Code. In the event of a product’s non-conformity, it may be returned, exchanged, or refunded.
All claims, requests for exchange, or refunds must be made by telephone at +33 1 88 61 57 57 within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be refunded based on the invoiced amount, and return shipping costs will be refunded upon presentation of proof of payment.
The provisions of this Article do not prevent you from exercising your right of withdrawal as provided for in Article 6.
Article 10 – Liability
The products offered comply with current French legislation. NEW COSMETIC FRANCE cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the import or use of the products or services you intend to order.
Furthermore, NEW COSMETIC FRANCE cannot be held liable for damages resulting from misuse of the purchased product.
Finally, NEW COSMETIC FRANCE cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.
Article 11 – Applicable Law in Case of Disputes
The language of this contract is French. These terms and conditions of sale are governed by French law.
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, NEW COSMETIC FRANCE has implemented a consumer mediation system. The designated mediation entity is: SAS CNPM – MÉDIATION – CONSOMMATION. Article 12 – Intellectual Property
All elements of the website www.botan.fr are and remain the exclusive intellectual property of NEW COSMETIC FRANCE. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the website, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of NEW COSMETIC FRANCE.
Article 13 – Personal Data
NEW COSMETIC FRANCE reserves the right to collect your personal information and data. This information is necessary for processing your order and improving the services and information we provide to you.
It may also be shared with companies that contribute to these services, such as those responsible for order fulfillment, processing, and payment.
This information and data are also retained for security purposes and to comply with legal and regulatory obligations.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to the personal information and data concerning you, directly on the website.
Article 14 – Online Reviews
In accordance with the provisions of Decree No. 2017-1436 of September 29, 2017, concerning information obligations relating to online consumer reviews:
Each review is submitted freely by users without any compensation. Experienced users who have already ordered a product through the site are identified by the “verified customer” rating. The maximum publication and retention period for a review is ten (10) years.
Reviews are published without modification. To be published, a review must reflect a real user experience while respecting the rules of use of the product in Instructions for Use and Precautions for Use, with remarks relating only to the product concerned, not mentioning competing brands, respecting basic rules of good conduct, not disseminating illegal, vulgar, obscene or any other shocking information of any kind, not infringing on the dignity of others or the rights of persons and not infringing on intellectual property rights or other rights of third parties, in particular trademark rights and copyrights.
Article 15 – Record Keeping and Proof
NEW COSMETIC FRANCE will archive order forms and invoices on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code.
The computerized records of NEW COSMETIC FRANCE will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
